Usage Policies, Rules, and Conditions

IMPORTANT: Before you use any of the services of Network IT/Internet America, read the following Usage Policies, Rules, and Conditions. Subscriber use of any service offered by Network IT/Internet America constitutes acceptance of and agreement by Subscriber to comply with said Usage Policies, Rules, and Conditions in their entirety.

The key contributing factors to decisions and actions taken on Usage Policies, Rules, and Conditions violations include but are not limited to protection of our customers and our resources, provision of quality service to our customers, compliance with applicable law, and the protection of our reputation as a service provider.

If a Network IT/Internet America account is involved in a violation of these policies, we reserve the right to suspend or terminate Service without notice.  Our preferred course of action would be to advise the account owner of the inappropriate behavior and any corrective action that may be necessary.  However, repeated or flagrant violations of these policies may result in immediate termination of Service.

USAGE POLICIES

Network IT/Internet America’s Dial-up Internet Access Accounts are single user accounts for use by one person and/or their immediate family in the same dwelling. Account sharing is not permitted. No more than one login session can be active at any one time on a Subscriber's account. Multiple simultaneous dial-up connections for an account are strictly prohibited and added charges may apply with possible cancellation of the account.

Internet access accounts cannot be transferred or used by anyone other than the Subscriber and members of the subscriber's immediate family in the same dwelling.

No Subscriber will be allowed to use Network IT/Internet America's Service in a manner that adversely affects the availability of Network IT/Internet America's resources to other Subscribers.

Subscribers to the "Unlimited Access" plan for dial-in users may make reasonable use of the Service without a specific limit on hours used and without paying more based on hourly usage.  Subscribers should keep the connection open only when actively using it, and may not use any automatic method to avoid inactivity disconnect.  Sessions on dial-in accounts which exceed a reasonable time may be terminated in order to protect network resources and preserve Service availability for other users.  In the event Network IT/Internet America determines that an account is frequently exceeding reasonable sessions times for dial-in accounts, the Subscriber will generally be notified by e-mail.  If the excess use continues after such notification, the Subscriber may be requested to upgrade the account's Service agreement or to modify the activity creating the excess use, or the account may be terminated.

Service may be disconnected after a significant period of inactivity.  Dial-up connections to Network IT/Internet America are automatically disconnected after 20 successive minutes of inactivity. We reserve the right to terminate the account, without notice, of anyone attempting to defeat this measure through any means, mechanical or electronic. These means include but are not limited to: using any e-mail program to continually check mail, continual pinging of any IP address, use of any other utility to falsely maintain a live connection.

Network IT/Internet America does not allow Subscribers to run a server over a dial-in connection. No account provided by Network IT/Internet America may be used as a connection for an Internet server of any type, whether commercial or personal, unless pre-approved through the management of Network IT/Internet America.

No one may resell connection time or services of Network IT/Internet America without the express written consent of Network IT/Internet America.

Internet Access Accounts are provided with up to 1 MB of Web Space to be used for personal non-commercial web pages. This is provided upon request. Network IT/Internet America is not responsible for assisting in the design of personal web pages and/or the training of using web-authoring software.  X-rated or pornographic material posted on the free web pages is strictly forbidden - no exceptions. If found, there will be one warning. Further violations will result in removing the web page privilege indefinitely. Network IT/Internet America reserves the right to refuse to link to personal web pages that it considers distasteful.

RULES

Subscriber will not use any of the services of Network IT/Internet America for any illegal purpose. Subscriber agrees to abide by all applicable federal, state and local laws. Network IT/Internet America will cooperate with law enforcement authorities in investigating Subscribers suspected of breaking the law.

Subscriber will not willfully or negligently use any of the services of Network IT/Internet America in a manner that could impair the operation of Network IT/Internet America’s system or that of its information providers. Subscribers will not willfully or negligently interfere with the normal use of Network IT/Internet America’s system by another Subscriber or other users of the Internet.

Subscriber is prohibited from spamming on the Internet.

Subscriber is prohibited from sending harassing emails to other users on the Internet.

Subscriber is prohibited from forging e-mail addresses so as to make the e-mail appear to be from another user.

Subscriber is prohibited from sending unsolicited commercial emails, "chain" or pyramid letters in mass over the Internet.

Subscriber is prohibited from hacking into the systems of others.

PASSWORDS

Subscriber is responsible for maintaining the confidentiality of his or her password in a manner so as to prevent unauthorized use of the account. 

CONDITIONS

Network IT/Internet America specifically reserves the right to, without prior notice, change their Usage Policies, Rules or Conditions, and/or change or discontinue services offered to Subscriber and/or change the prices for which said services are offered to Subscriber. Notification of any such change may be made via e-mail to Subscriber’s email account, posting on Network IT/Internet America’s web page or the United States postal service. If notification of the change is mailed via the United States postal service, it is deemed received within four days of mailing. If notification of the change is made by electronic means, it is deemed received when sent. Subscriber’s use of the Network IT/Internet America network after such notice is received shall constitute Subscriber acceptance of such modifications.

Network IT/Internet America cannot and will not exercise control over any of the information available via any of its services. We cannot and do not warrant the usefulness, quality or accuracy of any of the information available over the Internet via any of its services. Subscribers access and use said information and content via the services of Network IT/Internet America at their own risk.

Network IT/Internet America specifically warns Subscriber that by accessing the Internet via any of Network IT/Internet America’s services Subscriber may come into contact with material and information that Subscriber deems offensive or objectionable. Network IT/Internet America does not endorse said materials and information and is not responsible for deliberate or unintentional access to said material and information. Network IT/Internet America recommends that Subscribers carefully monitor access to the services provided by Internet America so as to guard against the deliberate or unintentional access to offensive, objectionable or inappropriate materials, content and information by minors. Software packages exist that are specifically designed to restrict the access of minors to the Internet. Concerned Subscribers should consider the use of said software as part of an overall effort to monitor access by minors to the information and material available via any of Network IT/Internet America’s services.

Network IT/Internet America specifically warns Subscribers that by accessing the Internet via any of Network IT/Internet America’s services Subscriber’s computer (hardware and software) and files may be infected by computer viruses. Internet America is not responsible for any loss or damage associated with or arising from infection by computer viruses acquired via the Internet. Subscriber browses the Internet and downloads material and information off the Internet at Subscriber’s own risk. Software packages exist that are specifically designed to intercept and/or disable viruses. Subscribers should consider the use of said software as part of an overall effort to maintain the integrity of Subscriber’s computer and preserve data contained in Subscriber’s files.

Various products and services are available for purchase from merchants and vendors on the Internet. Subscribers order and/or purchase such products and services at their own risk. Network IT/Internet America cannot and will not be liable for any acts or omissions of Subscriber and/or merchants in connection with any orders and/or purchases initiated and/or made on the Internet.

Network IT/Internet America reserves the right to investigate Subscriber’s account for suspected violations of the Usage Policies, Rules, Conditions, or any other such conduct Network IT/Internet America, in its sole discretion, deems may harm other Subscribers, Network IT/Internet America’s system or its business interests or Internet America’s information providers. Network IT/Internet America warns Subscribers that violations of the Agreement could also subject the Subscriber to criminal or civil penalties.

Network IT/Internet America may terminate or suspend Subscriber’s services at any time, without notice, for violations of the Usage Policies, Rules, Conditions, or any such other conduct Network IT/Internet America, in its sole discretion, deems may harm other Subscribers, Network IT/Internet America’s system and/or business interests, or Network IT/Internet America’s information providers.

In the event that Subscriber’s account is terminated or suspended, Network IT/Internet America is not responsible for maintaining or delivering Subscriber’s e-mail.

Network IT/Internet America is not liable for the deletion, garbling or loss of messages, other communications, or other content maintained or transmitted by our services.

Network IT/Internet America may terminate or change Subscriber's password, account, or usage of any of Network IT/Internet America's services, and may remove any Subscriber's content, from Network IT/Internet America's servers without notice and for any reason, including lack of use or violation of these Usage Policies, Rules & Conditions.


Network IT/Internet America reserves the right to change these policies and rules at any time without notice.
